Terms of Sale

These Terms of Sale apply to every order placed in the OYA online store. By placing an order, you accept them. They are available on this page at any time and are referenced in your order confirmation email.

1. Seller

2. Scope

These Terms govern distance sales to consumers, meaning people buying for personal or household use. Orders intended for resale are not accepted; we may refuse or limit them.

3. Products

At launch, the OYA store offers reusable double-wall bottles in two sizes, Mini (16 oz, approx. 470 ml) and Big (25 oz, approx. 740 ml). Each bottle has an NFC chip in its base that opens the OYA app, and a word engraved inside the cap. The colour and the word are those shown on the product page; they cannot be personalised.

Further OYA products will be added to the store over time. The product page describes each product's characteristics, and these Terms will be updated before any new product category goes on sale.

Product photos are as accurate as possible. A slight difference between the colour on your screen and the actual product is not a defect.

Wash the bottle before first use and follow the care instructions supplied with it.

 

4. Prices

Prices are shown in Swiss francs (CHF) and include Swiss VAT at the applicable rate. The breakdown appears on your invoice.

Shipping costs are shown before payment and are added to the product price, unless shipping is stated as included.

The price that applies is the one displayed when you place your order. In case of an obvious pricing error, we will inform you, and you may either confirm the order at the correct price or cancel it at no cost.

5. Order and contract

The contract is concluded when your payment is accepted. You then receive a confirmation email listing the products (size and colour), their price, the shipping cost and the delivery address.

Bottles are produced in limited runs per colour. If a colour is no longer available after you order, we will tell you without delay: you may choose another colour or receive a refund for that item.

6. Payment

The available payment methods are shown at checkout. Payments are processed by Shopify and its payment partners; we never see or store your card details. Your payment method is charged when you place the order.

7. Delivery

We deliver to Switzerland and Liechtenstein. Orders for addresses outside this area cannot be fulfilled and will be refunded.

Two shipping methods are available:

• Express, delivered the working day after dispatch: CHF 13.90

• Standard, delivered within 72 hours of dispatch: CHF 8.90

The selected method and its price are shown before payment.

Benefit and risk pass to you on delivery of the parcel. If the carrier loses a parcel, we will replace or refund it. Delivery delays do not give rise to compensation, but we will help you open a trace request with Swiss Post.

8. Returns within 14 days

Swiss law does not provide a general right of withdrawal for online purchases. The following is a voluntary commitment on our part.

You may return an unused product in its original packaging within 14 days of receipt. Announce the return to onyouraura.shop@gmail.com with your order number, then send the product to the address given in our reply. Return shipping costs are borne by you.

Once we have received and checked the product, we refund its price to your original payment method within 10 days. Original shipping costs are not refunded.

For hygiene reasons, a bottle that has been used for drinking cannot be returned under this section. This does not limit your rights in case of a defect (section 9).

 

9. Defects and legal warranty

If a product arrives damaged, incomplete or not as described — for example a dent, faulty insulation, a leaking cap, or an NFC chip that does not respond on arrival — report it within 7 days of receipt, with a photo, to onyouraura.shop@gmail.com. We will replace or refund it, as you prefer, without asking you to return it at your own cost.

Beyond that, the statutory warranty for defects applies under articles 197 et seq. of the Swiss Code of Obligations, for two years from delivery. It does not cover normal wear (scratches, paint patina), impacts and drops, or use and care contrary to the instructions supplied with the product.

10. OYA app

The NFC chip opens the OYA app. The app is a separate service governed by its own terms; its content, availability and any subscription to it are not part of this contract of sale. A chip that does not respond on arrival is covered by section 9.

11. Relationship with Shopify

The store is powered by Shopify. Every sale made in this store is concluded directly between you and PPG-Doctors AG. Shopify is not a party to the contract of sale and is not responsible for the products sold or their delivery.

12. Intellectual property

The OYA brand, logo, texts, photographs and visuals in this store are protected. Any reproduction, even partial, requires our written consent.

13. Personal data

We process your personal data in accordance with the Swiss Federal Act on Data Protection (FADP). Details are set out in our Privacy Policy.

14. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the registered office of PPG-Doctors AG, subject to mandatory consumer jurisdictions, in particular the courts of the consumer's place of residence.

15. Changes to these Terms

We may amend these Terms. The version in force when you place your order applies to that order.
